Terms and Conditions

Welcome to Yze Dogs

These Terms and Conditions govern your use of the Yze Dogs website and the purchase or booking of services from Yze Dogs.

By using this website, submitting a booking, purchasing a service, enrolling in a course, or making payment for a Yze Dogs service, you acknowledge that you have read and agree to these Terms and Conditions.

These Terms and Conditions are subject to the applicable laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

Nothing in these Terms and Conditions is intended to limit or exclude any right or protection that a consumer has under applicable South African law.

1. Definitions

For the purposes of these Terms and Conditions:

“Yze Dogs”, “we”, “us” or “our” means Yze Dogs and its owner, trainers, representatives or authorised service providers.

“Client”, “you” or “your” means the person purchasing, booking or receiving a Yze Dogs service.

“Dog” means any dog receiving, or intended to receive, training, behaviour consultation, assessment or any other service from Yze Dogs.

“Service” means any training, behaviour consultation, assessment, class, course, walk, workshop or other service offered by Yze Dogs.

“Booking” means an appointment, reservation, enrolment or other arrangement made for a Yze Dogs service.

2. Yze Dogs Services

Yze Dogs provides professional dog training and behaviour services, including private training, behaviour assessments, puppy training and other dog-related services as advertised on the Yze Dogs website.

Services, prices, availability and specific service conditions may change from time to time. The terms and price applicable to a booking are those presented to the Client at the time of booking or purchase, subject to any rights provided by applicable law.

A booking is not considered confirmed until the required payment has been received and, where applicable, Yze Dogs has confirmed the booking.

3. Bookings and Appointments

Yze Dogs operates by appointment.

When a Client books an appointment, the agreed date and time are reserved specifically for that Client and their dog(s).

Because appointments are limited and cannot generally be offered to another Client at short notice, Clients are expected to provide as much notice as reasonably possible when they need to cancel or reschedule.

Clients are responsible for checking their booking details and ensuring that they are available at the agreed date and time.

4. Payment

Payment must be made in accordance with the payment terms displayed for the relevant service.

Where advance payment is required, the booking will only be confirmed once payment has been received.

Yze Dogs reserves the right not to provide a service where the required payment has not been received, subject always to applicable consumer rights.

Prices displayed on the website are subject to change. A price already agreed and paid for a confirmed booking will not be changed retrospectively.

5. Cancellation, Rescheduling and Refunds

Yze Dogs understands that circumstances can change. Our cancellation policy is intended to be fair to both Clients and Yze Dogs while recognising that an appointment represents time specifically reserved for the Client.

The cancellation and refund provisions below apply subject to any mandatory rights the Client may have under South African law.

5.1 Cancellation more than 48 hours before an appointment

If a Client cancels a private appointment with more than 48 hours’ notice, the Client may choose either:

  • a full refund of the amount paid; or
  • one free rescheduling of the appointment to an available date and time.

Where a refund is requested, it will be processed within a reasonable period and in accordance with applicable law and the payment method used.

5.2 Cancellation less than 48 hours before an appointment

Where a Client cancels an appointment with less than 48 hours’ notice, Yze Dogs may retain a reasonable cancellation charge of 50% of the applicable service fee.

The remaining amount, if any, may be refunded or credited towards a rescheduled appointment at Yze Dogs’ discretion.

The cancellation charge is intended to compensate for the reasonable loss associated with holding the appointment and the reduced opportunity to offer that appointment to another Client.

5.3 Same-day cancellation

Where a Client cancels an appointment on the day of the appointment, or provides insufficient notice for Yze Dogs to reasonably offer the appointment to another Client, the full service fee may be charged or retained.

This includes cancellations made shortly before the scheduled appointment.

5.4 No-shows

If a Client fails to attend a confirmed appointment without providing reasonable notice, the appointment will generally be treated as a cancellation on the day of the appointment and the full service fee may be charged or retained.

A Client arriving late does not automatically entitle the Client to an extension of the scheduled appointment. The session will generally end at the originally agreed time.

5.5 Rescheduling

Clients are encouraged to reschedule rather than cancel where possible.

A Client who provides more than 48 hours’ notice may reschedule once without an additional charge, subject to availability.

Repeated rescheduling, particularly at short notice, may be treated as a cancellation.

Yze Dogs is not obliged to make a particular date or time available for a rescheduled appointment.

5.6 Exceptional circumstances

Yze Dogs will consider genuine exceptional circumstances reasonably and fairly.

In accordance with the Consumer Protection Act, Yze Dogs will not impose a cancellation fee where the Client is unable to honour a booking because of the death or hospitalisation of the person for whom, or for whose benefit, the booking was made.

Other serious circumstances may also be considered at Yze Dogs’ reasonable discretion.

Clients should contact Yze Dogs as soon as reasonably possible when an emergency affects their ability to attend an appointment.

6. Cancellation by Yze Dogs

Yze Dogs reserves the right to cancel or reschedule an appointment where reasonably necessary, including because of illness, emergency, unsafe conditions, circumstances affecting the dog trainer, or other circumstances outside of Yze Dogs’ reasonable control.

Where Yze Dogs cancels a prepaid appointment and the Client does not wish to reschedule, the Client will be entitled to an appropriate refund of the amount paid for the service that has not been provided, subject to applicable law.

Yze Dogs will not charge a Client for a service that has been cancelled and not provided. However, where an appointment cannot safely proceed or must be ended because of safety concerns arising from the Client’s conduct, failure to disclose material safety information, or failure to follow reasonable safety instructions, reasonable travel costs actually incurred may be considered when determining any refund, to the extent permitted by applicable law. Any deduction will be assessed fairly in light of the circumstances and explained to the Client.

7. Packages

Where Yze Dogs offers services as a package, the package price may represent a discounted price compared with purchasing the individual services separately.

Once a package has commenced, a Client who wishes to cancel the remaining services may request a refund of the unused portion.

Where appropriate, the refund will be calculated by taking into account:

  • the individual value of services already provided;
  • any discount attached to the package;
  • any reasonable cancellation charge applicable to the circumstances; and
  • any other amount that may lawfully be retained.

A package does not become automatically refundable in full simply because some sessions remain unused.

Nothing in this section limits any statutory consumer right to a refund or cancellation where such right applies.

8. Group Classes and Courses

Group classes and courses may have specific enrolment dates, course periods, capacity limits and attendance requirements.

Because a place in a group class is reserved specifically for the enrolled Client and their dog, cancellation and refund conditions may differ from those applicable to individual appointments.

The specific cancellation and refund conditions displayed when enrolling for a particular course will apply, subject to applicable South African law.

If a course has already commenced, refunds will generally be considered based on the portion of the course already provided and the circumstances of the cancellation.

9. Online Transactions and Consumer Rights

Where a transaction is concluded electronically, the Client retains any rights provided by applicable South African law, including applicable rights under the Electronic Communications and Transactions Act 25 of 2002.

Where applicable, statutory cooling-off rights, cancellation rights or refund rights will take precedence over these Terms and Conditions.

Certain statutory cooling-off provisions may not apply in circumstances where the law provides an exception, including circumstances where services have already commenced with the Client’s consent.

Yze Dogs will not attempt to contract out of a consumer right that cannot lawfully be excluded.

10. Client Responsibilities

Clients are responsible for providing Yze Dogs with accurate and relevant information about their dog.

Before training or behaviour services commence, Clients must disclose any information that may reasonably affect the safety or effectiveness of the service, including where applicable:

  • known aggression or reactivity;
  • previous bite incidents;
  • fear-related behaviour;
  • resource guarding;
  • behavioural problems;
  • medical conditions;
  • injuries or pain;
  • medication that may affect behaviour;
  • relevant veterinary or behavioural history; and
  • any other circumstance that may reasonably affect the safety of the dog, Client, trainer or other persons or animals.

Failure to disclose relevant information may affect the safety of the session and the ability of Yze Dogs to provide appropriate advice.

Clients remain responsible for their dog at all times unless Yze Dogs has expressly agreed otherwise.

11. Dog Safety and Behaviour

Dogs are living animals and their behaviour can be affected by their environment, health, genetics, learning history, stress, fear, arousal and many other factors.

Although Yze Dogs takes reasonable steps to provide safe and professional training and behaviour services, no dog trainer can guarantee that a dog will never bite, escape, fight, injure itself, injure another animal, damage property or display unwanted behaviour.

Clients must follow reasonable safety instructions provided by Yze Dogs during training or behaviour consultations.

Yze Dogs may modify, pause or terminate a session where continuing would create an unreasonable safety risk to the Client, trainer, dog or another person or animal.

Where appropriate, Yze Dogs may recommend veterinary assessment, veterinary treatment or referral to another qualified professional.

Yze Dogs may decline to begin, or may immediately pause or end, an assessment or session if I reasonably believe that my safety or the safety or welfare of another person or animal is at risk.

This includes situations involving threatening or abusive conduct, failure to disclose material safety information, or refusal to follow reasonable safety instructions.

I am not required to continue an appointment where I have reasonable safety concerns.

12. Suitability and Safety Screening

All behaviour assessment enquiries are subject to an initial discussion to determine whether the case is suitable for Yze Dogs and whether the assessment can reasonably be conducted safely.

Yze Dogs reserves the right to decline an enquiry or booking where the circumstances fall outside my professional scope, where reasonable safety concerns cannot be adequately addressed, or where veterinary care or another suitably qualified professional would be more appropriate.

Clients must provide accurate and relevant information during the initial discussion and cooperate with reasonable safety arrangements before and during the appointment.

An appointment confirmation or payment does not guarantee that an assessment will proceed if new information or circumstances raise safety or welfare concerns.

13. Training Results

Dog training and behaviour modification are influenced by many factors, including the dog’s individual temperament, learning history, environment, health, the Client’s consistency and the implementation of training between sessions.

Yze Dogs provides professional guidance, training and behaviour recommendations but does not guarantee a particular behavioural outcome or timeframe.

The effectiveness of training depends significantly on the Client’s continued implementation of the techniques and recommendations provided.

A behaviour assessment or training session is not a guarantee that a particular behaviour will be permanently eliminated.

14. Professional Advice and Veterinary Care

Yze Dogs provides dog training and behaviour services and does not replace veterinary care, veterinary diagnosis or veterinary treatment.

Where a dog’s behaviour may be affected by pain, illness or another medical condition, Yze Dogs may recommend that the Client consult a veterinarian.

Clients remain responsible for obtaining appropriate veterinary care for their dog.

15. Liability

Yze Dogs takes reasonable care in providing its services.

To the maximum extent permitted by South African law, Yze Dogs will not be liable for loss, injury, damage or expense arising from circumstances outside of Yze Dogs’ reasonable control or from a Client’s failure to follow reasonable instructions or disclose relevant information.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms and Conditions excludes or limits any consumer rights or statutory remedies that cannot legally be excluded or limited.

16. Client Property and Personal Belongings

Clients remain responsible for their own personal belongings and equipment brought to a training session or other Yze Dogs service.

Yze Dogs is not responsible for loss or damage to personal property except where liability arises under applicable law.

16. Intellectual Property

Unless otherwise stated, the content on the Yze Dogs website, including text, photographs, graphics, logos, videos, training materials and other original content, belongs to Yze Dogs or its licensors.

No content may be reproduced, republished, distributed, modified, sold or commercially exploited without prior written permission from Yze Dogs, except where permitted by law.

17. Website Content

Yze Dogs makes reasonable efforts to ensure that information published on the website is accurate and current.

However, information, prices, availability and service offerings may change from time to time.

Yze Dogs does not guarantee that the website will always be available, uninterrupted or completely free from errors.

Nothing on the website constitutes a guarantee of a particular training or behavioural outcome.

18. Links to Other Websites

The Yze Dogs website may contain links to external websites or services.

Yze Dogs is not responsible for the content, privacy practices, availability or operation of external websites.

Following an external link is done at the user’s own discretion.

19. Privacy

Yze Dogs collects and processes personal information in accordance with its Privacy Policy and applicable South African privacy legislation.

Clients are encouraged to read the Yze Dogs Privacy Policy to understand how personal information is collected, used and protected.

20. Changes to These Terms and Conditions

Yze Dogs reserves the right to update or amend these Terms and Conditions from time to time.

The version applicable to a particular booking or transaction will generally be the version in effect at the time the booking or transaction was concluded, subject to any mandatory legal requirements.

Where a material change affects an existing Client relationship, Yze Dogs will take reasonable steps to communicate the change where required.

21. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the consumer’s statutory rights.

Nothing in these Terms and Conditions prevents a consumer from exercising any right to approach a competent court, consumer protection authority, tribunal or other legally available dispute-resolution mechanism.

22. Agreement

By booking, purchasing or using a Yze Dogs service, the Client confirms that they have had an opportunity to read and understand these Terms and Conditions.

The Client agrees to comply with these Terms and Conditions, subject to all rights and protections provided by applicable South African law.

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be severed or limited to the extent necessary, without affecting the validity of the remaining provisions.
